Fauci took some punches, called out for not being able to claim the 5th as he’s been pardoned, “you were pardoned, so you cannot claim the Fifth” yet he repeatedly took the 5th anyhow, seems both Rand Paul and Josh Hawley stated the same
a pardoned witness generally cannot invoke the Fifth about the pardoned federal conduct,Brown v. Walker, Burdick v. United States , Kastigar v. United States ,United States v. Apfelbaum ,United States v. Whittington but he may still invoke it if a truthful answer could expose him to unpardoned criminal liability, i.e. not federal…

Maybe on the federal stuff tied to the pardon, but not on fresh exposure outside it. If there’s still unpardoned criminal liability in play, the Fifth can still be live.
That’s the wrinkle — pardoned conduct and unpardoned conduct aren’t the same box. The hard part is the exact scope of the pardon and what question was actually asked.
That’s where these fights usually live or die.

Fauci looked dishonest and foolish. I mean, pleading the 5th on the color of your tie?
At the same time, Kilroy made a cogent point. On the more substantive questions, I don’t know whether pleading the 5th and a presidential pardon are mutually exclusive. The scoping issue could mean Fauci gets away, at least in the earthly court.
If he does escape in this life, I’m certain he will not escape justice in the hereafter.
I’m wondering now, what can we do for the victims, and how do we stop a second Fauci, if pardons eliminate the deterrence factor?
