That might apply to ATF GCA and NFA confiscation activities. On their side, the officers would probably argue that they have a sworn duty to obey orders and enforce the law. I don’t believe that can hold when the law conflicts with the supreme law of the Constitution.
There is a similar idea in contract law. If a party contracts to violate the law, or if a condition of the contract is not permitted by law, the contract has no force. In other words, an illegal contract is unenforceable.
This might even trace back to the concept that oaths made in conflict with the G.d’s word are vain oaths as mentioned in the Decalogue (Ex. 20:7), “Do not take the name of the L.rd your G.d in vain.” One who makes an oath explicitly in conflict with the higher law of the Bible has taken G.d’s name in vain, and the oath itself has no force, so he may (or must!) violate his vain oath.
Shevuot 3:8 What is a vain oath? […] [If one] said to witnesses, “Come and testify for me,” [and they respond, “We take] an oath that we will not testify for you.” They have sworn to refrain from a commandment. [Lev. 5:1 “If a person sins, whereby … he is a witness… yet he does not testify, he shall bear his transgression.”]
