It’s just a DOJ Memo, though. Congress would still need repeal that provision of the US Code, but I doubt they would, and I doubt the Supreme Court would agree with DOJ’s memo if the issue came before it, which I also doubt would happen.

It also opens up a line of argument in court if a future DOJ reverses its position. It will be like the brace rule, which was similarly struck down, partly because the ATF reversed its opinions.

?So why doesn’t someone file suit over this. It would go to court, then one could call upon the DOJ to testify to ITS opinion on the ban being unconstitutional. THAT ought to help the suit.

You rely upon corruption as the sole arbiter of who is or isn’t to blame. IMM corruption is the byproduct of the Far Left ideology - which at its core is communistic. ALL communist nations are run corruptly; the byproduct is that generally speaking, the “kissing cousin” - socialism - is also corrupt, only less so. Look at Sweden. About 100 yrs ago it was among the 5-10 poorest nations around. Then in the later 20th century they became among the top 10 richest countries. They did it by scrupulously adhering to capitalistic ideals. THEN they decided to “help their people” - by gong socialist. And in the space of 10-20 years they squandered ALL the accumulated wealth it had taken them a century to get. NOW they’re trying to return to capitalism, but fear an all-or-none approach, so they have curbed a good bit of their social give-aways and reinstituted capitalist laws to aid companies recover. They are hoping to succeed, but time will tell.
We too have a socialist issue - driven by the Far Left. The Democrat Party drove out all true liberals and has nothing but hardcore communists left. It shows in their attitudes towards laws, the peaceful relinquishing of power, the reaction to the DOGE uncovering of absolutely massive fraud and corruption within the NGO system of spoils that the Democrats instituted.
What you have left there is a party in civil war. Many “Old Line” “Republicans” are nothing but RINO’s in a district that won’t elect a Democrat, so they masquerade as Republicans. Note the recent vote in the House to continue the corrupt payouts, etc some 88 alleged “Republicans” voted with the Dems to squash the amendment that would have cut off aid to illegals! THAT is a phenomenal number of Republicans that voted directly AGAINST what the people voted FOR in electing Trump! Hopefully they will all be primaried out of a seat.
ALL THIS is the work of the Far Left. No matter the label, they are a distinct group that is easily identifiable, whether or not they wear the 
“progressive” or “liberal” label.
Of if they wear the Republican label, those 88 Republicans should quickly be fired. If I was in control ,

I agree with @Devereaux , liberals rely upon a system of spoils and rewards for capitulation to socialist or worse, communist masters. A fairy tale promise of personal desires fulfilled at the expense of a “ scapegoat “, personal power over a perceived enemy or inequality , sharing the wealth or fruit of another’s hard work without having to earn it themselves. Witness Mamdani, his hollow promises are already being broken by reality; money doesn’t lie. Pure capitalism weeds out the ne’erdowells, lazy and unproductive, exposes the lie at the heart of socialism. Also, competition creates winners And losers, something that liberals won’t admit, there is no level playing field, no equality. Since every true winner has lost more than once, a system of civic rules or honor system is created by a just society where meritocracy is the basis of society; race or other tools of socialism gain no foothold, no one to blame but yourself since if you don’t succeed.
